Welcome to Contest Pro. Contest Pro is a google android and apple iPhone based mobile software application including features and accounts as defined below owned and operated by Globally Ignited LLC., a corporation organized and existing under the laws of the state of Texas.
PLEASE READ THESE TERMS OF SERVICE (THE “TERMS”) CAREFULLY. BY ACCESSING AND OR USING THIS APP (OTHER THAN TO READ THIS AGREEMENT FOR FIRST TIME) , YOU ARE AGREEING TO COMPLY WITH THESE TERMS WHICH MAY CHANGE FROM TIME TO TIME WITHOUT ANY NOTICE TO YOU, AS SET FORTH HEREIN BELOW.
THIS AGREEMENT IS A BINDING AGREEMENT BETWEEN CONTEST PRO AND YOU (“YOU" OR “USER”). YOUR CONTINUED USE OF THIS APP SHALL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES, IF YOU DO NOT AGREE TO THIS AGREEMENT AND OR THE PRIVACY POLICY AND OR THE COPYRIGHT POLICY, THEN YOU MAY NOT USE THE APP AND SHALL DISCONTINUE DOING SO IMMEDIATELY.
YOU ARE HEREBY AFTER USAGE OF SAID APP ENTERING INTO AND AGREEING TO BE BOUND BY THIS AGREEMENT.
IF YOU DO NOT AGREE OR WISH TO BE BOUND BY THIS AGREEMENT, DISCONTINUE YOUR USAGE OF THIS APP AND OR TERMINATE YOUR ACCOUNT IN ACCORDANCE WITH THE TERMS HEREIN.
1. INTELLECTUAL PROPERTY
This mobile app and its content, including but not limited to features and all functionalities related incidentally and/or indirectly thereto, and any derivative works or enhancements of the same, including but not limited to all texts, images, software, scripts, graphics, photos, sound, information, content, materials, products, services, urls, technology, documentation and all intellectual property rights to the same are owned by Globally Ignited LLC. Also, all trademarks, service marks, trade names that may appear on the app are owned by Globally Ignited LLC. Except for the limited use rights granted to you in these terms, you shall not acquire any
right, title or interest in the mobile app or any other intellectual property of Globally Ignited LLC. Any rights not expressly granted in these TERMS are expressly reserved.
2. USERS
A. “Users: shall mean any individual who completes the registration to become a registered user as set forth herein below. - who downloads, installs views, accesses and/or uses the mobile app in any manner whatsoever, including but not limited to You and other individuals as context may require.
B. If you are under the age of 13 years old, then you are not permitted to register as a User or otherwise submit personal information.to the app. Globally Ignited LLC will not knowingly collect any personally identifiable information from children under the age of 13 years., without prior consent of such child’s parents or guardians.
C. You are responsible for safeguarding and maintaining the confidentiality of your account. You are solely responsible for the activity that occurs under your account, whether or not you have authorized the activity.
D. To register an account and become a registered user, User agrees to pay to Globally Ignited LLC, a one-time download fee of $ 0.99 ( United States dollar) for each download of the app from the apple and/or google play store.
E. Globally Ignited LLC may make changes to the mobile app or to the applicable registration fee, at any time, without notice. The content on the mobile app may be out of date and Globally Ignited LLC makes no commitment to update the materials there with respect to the aforementioned.
F. Registered users shall indemnify, reimburse and hold Globally Ignited LLC harmless for any and all liability arising from the app, its features, account and/or registration fee to the extent permitted by law and in accordance with section below
G. By accepting these terms, you specifically agree that the processing of payments is handled by a third party other than Globally Ignited LLC and is subject to the indemnifications and limitation of liability reflected in sections below.
H. You agree that at all times while using the mobile app that you will comply with applicable federal, state, international and local laws including without limitation, copyright law. Except as expressly permitted in these terms, you may not use, reproduce, distribute, create derivative works based upon publicly display, publicly perform, publish, transmit or otherwise exploit the application for any purpose, whatsoever without obtaining prior written consent from Globally Ignited LLC.
I. These rights hereby established by these TERMS shall be effective until terminated. Globally Ignited LLC may terminate or change these terms with or without any notice to you whatsoever.
J. User generated content includes information about you to Globally Ignited LLC at the time of registration or while searching for competitions. By submitting this information on our app, you assign and transfer all rights and title therein to Globally Ignited LLC to the fullest extent permissible by law. As such Globally Ignited LLC may use , reproduce, modify, adapt, publish, translate, create derivative works, distribute, perform and display all user generated content including but not limited to information communicated to Globally Ignited LLC through the mobile app. And to incorporate any user generated content in other works in any form, media or technology now known or later developed. Globally Ignited LLC will also be free to use any ideas, concepts, know how or techniques contained in the user generated content for any purpose whatsoever. Including without limitations, developing, manufacturing, marketing products and services incorporating such information.
3. Indemnification
YOU AGREE TO INDEMNIFY AND HOLD HARMLESS GLOBALLY IGNITED LLC AND ITS EMPLOYEES, AGENTS, PARTNERS, AFFILIATES FROM AND AGAINST ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, OBLIGATIONS, COSTS AND EXPENSES( INCLUDING REASONABLE ATTORNEY FEES) ARISING OUT OF OR RELATED TO OR THAT MAY ARISE IN CONNECTION WITH:
(1) YOUR ACCESS TO OR USE OF THE MOBILE APP
(2) USER GENERATED CONTENT PROVIDED BY YOU OR THROUGH USE OF YOUR ACCOUNT
(3) LOSS OR DAMAGE TO ANY USER CONTENT FOR ANY REASON
4. DISCLAIMERS
YOU EXPRESSLY AGREE THAT USE OF THE MOBILE APP IS AT YOUR OWN SOLE RISK. THE MOBILE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. GLOBALLY IGNITED LLC DISCLAIMS ANY AND ALL WARRANTIES INCLUDING ANY:
1. WARRANTIES THAT THE MOBILE APP WILL MEET YOUR REQUIREMENTS
2. WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, SECURITY, USEFULNESS, TIMELINESS OR INFORMATIONAL CONTENT OF THE MOBILE APP
3. WARRANTIES OF SERVICES RECEIVED THROUGH OR ADVERTISED ON OUR MOBILE APP.
4. WARRANTIES CONCERNING THE ACCURACY OR RELIABILITY OF THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THIS MOBILE APP
5. WARRANTIES THAT YOUR USE OF THE WEBSITE WILL BE SECURE OR UNINTERRUPTED AND WARRANTIES THAT ERRORS IN THE MOBILE APP WILL BE CORRECTED. ANY CONTENT OBTAINED BY USING THE MOBILE APP IS DONE AT YOUR OWN DESCRITION AND RISK. GLOBALLY IGNITED LLC WILL HAVE NO RESPONSIBILITY OR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY CONTENT
OR SOFTWARE.
DISPUTES INVOLVING GLOBALLY IGNITED LLC
IN THE EVENT THAT A LAW SUIT IS FILED AGAINST A USER AND GLOBALLY IGNITED LLC HAS TO SEEK LEGAL COUNSEL, THE USER SHALL PAY FOR ALL LEGAL FEES ASSOCIATED WITH THE LAWSUIT. THIS CLAUSE IN NO WAYS LIMITS GLOBALLY IGNITED LLC’S RIGHT TO HIRE LEGAL COUNSELOF ITS CHOICE.
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED ACCORDING TO THE LAWS OF THE STATE OF TEXAS.
